  • Essay / How does child marriage in India violate the Convention...

Child marriage in developing countries violates the Convention on the Rights of the Child. This law was designed to protect every child. Child marriage refers to a marriage or union in which one or both participants are under the age of eighteen (UNICEF, 2001). This essay focuses on the question of what rights are violated by child marriage and what are the reasons for this violation. Poverty, low education levels and cultural influences have been found to be the reasons for this persistent problem. Possible solutions to eradicate child brides are a higher level of education for girls and a strengthening of the rights system. This is analyzed by examining the United Nations Rights of the Child and Prohibition of Child Marriage Act (2006), replacing the Restraint of Child Marriage Act (1929). This prohibits the marriage of a girl under 18 and under 21 for a boy. The problem with child marriage is that young children are deprived of their childhood, removed from their safe environment, abused and not allowed to be educated. Child marriage is a practice that violates not only the fundamental rights of people, outlined in the Universal Declaration of Human Rights, but also the inherent rights of children, summarized in the Convention on the Rights of the Child. It is a global problem, particularly prevalent in developing countries, where around one in three girls will be married before the age of 18, and India ranks first in marriage prevalence children with approximately 47% of women married before the age of 18. (Girls Not Brides, 2014). Child marriage violates several articles of the Convention on the Rights of the Child and the Universal Declaration of Human Rights (UDHR).
