    SUBJECT: Decentralization; Is the decentralization structure enshrined in the 2010 constitution the best form of governance and decentralization of power and resources for Kenya? INTRODUCTION The 2010 Constitution is the hallmark of the adoption of decentralization in Kenya. Its promulgation on August 27, 2010 was momentous as it rewarded the concerted efforts made by many Kenyans over decades to rid Kenya of the highly centralized system of government in favor of decentralization. Through Article 6(1) of the constitution, Kenya adopted a decentralized system of governance. This article states that "The territory of Kenya is divided into the counties specified in the First Schedule." As stated in this first schedule of the constitution, Kenya is subdivided into 47 counties. Chapter eleven describes in more detail how this whole system will work – the fundamentals of its implementation. Chapter eighteen focuses on the procedural transition from the centralized system to its eventual full implementation. However, this system as enshrined in the constitution is not the best for Kenya. In short, it is unfavorable for Kenya. Many factors and considerations are taken into account when choosing the governance structures best suited to each of the world's different and diverse societies. The circumstances and factors prevailing in our Kenyan society do not sit well with this system as it is. These factors considered above include the economic power of the nation, ethnic composition, population size, immediate needs of the population, etc. This critique hereby adopted will form the basis on which this article rests.
