They determine by law the meaning of the constitution, can create courts lower than themselves and serve as a court of appeal. I will discuss how they gained their power, the things they do to decide which court cases they will review, and how the review process works. At one time, the court had to review every case received by writ of error under common law. Law. In 1914, the courts were given jurisdiction over certiorari matters. This allowed them to choose cases. They would not consider cases that were not supported by four judges. Initially, it was applicable only to decisions favoring rights asserted under federal law. In 1916, all cases involving denials of federal rights were transferred to certiorari jurisdiction. The Judiciary Act of 1925 finalized the Supreme Court's ability to choose cases.
