Pakistan is a developing country that has recently (about fifty years ago) developed its democratic systems. The current legislature has limited power and competes with parallel judicial systems. The unique socio-cultural frameworks of Pakistan must be understood to ensure that freedom and justice are accessible to all members of society. It is in this regard that it is important to evaluate the current system of laws protecting the rights of submissives in a patriarchal society. Therefore, domestic violence and violence laws need to be understood and evaluated in an attempt to make Pakistan a more just society. The Pakistan Penal Code does not have a separate subtitle detailing and identifying domestic crimes and the punishment of such crimes. Although domestic violence is not specifically recognized, certain elements of violence and domestic violence are covered under different subheadings of the Pakistan Penal Code. For example, laws recognize their role in protecting individuals from real or perceived emotional, psychological, mental, physical and/or economic abuse and harm. Therefore, laws relating to bodily harm can be extended to apply to cases of physical domestic violence. (Pakistani Law Firm, 2012). While it is important to recognize that laws from other categories can be applied to domestic crime cases, it is essential to note that the absence of a specific category results in many problems. It is of vital importance to note that all laws and their penalties arise from the socio-economic and cultural framework of the society for which the laws are designed. In conclusion, it can be seen that the current state of laws is incapable of helping victims and the creation of a separate category of law will have many benefits of faster detection and assessment of cases.
