Officials are involved in organ trafficking, showing that organ trafficking is a valid problem that needs to be addressed. Currently, the National Organ Transplant Act of 1984 (NOTA) does not prohibit U.S. citizens from purchasing organs outside the United States. In “Can the government ban the sale of organs?” Recent Legal Challenges and the Future of the U.S. Law on the Sale of Human Organs and Other Tissues,” Glenn I. Cohen states that “. . . If a U.S. citizen travels abroad to purchase a kidney or other organ, his or her act is not prohibited by NOTA and it is generally accepted that the more general U.S. laws prohibiting trafficking do not apply to the sale of kidneys. 'organs' (Cohen 1984). Purchasing organs outside the US transplant system is not yet illegal, but it is frowned upon. The moral issue surrounding organ donation is prevalent in today's society. The Pope declared that organ donation was an act of value. “Organ donation is considered a gift of love and is part of a philosophy of communication adopted by most religions” (Tonti-Filippini 410). In most religions, organ donation is considered honorable for the human race. Organ donation must be accepted in the same way that organ trafficking must be controlled because it is immoral. Organ shortages are now causing a more widespread black market in organ trafficking. “The illegal organ trade accounts for ten percent of organ transplants worldwide, generating between $600 million and $1.2 billion in illicit revenue each year” (Kelly 1319). Organ shortages are driving people to participate in the black market for organ transplants, and it brings in a lot of money. In the United States and around the world, there is an abundant shortage of organs and a high need for organs. donors.
